1. Agreement to Terms

By accessing or using abee.pro ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

The Service is operated by Nathan Cobb ("we," "us," or "our"). These terms constitute a legally binding agreement between you and us.

2. Description of Service

abee.pro is an A/B testing and experiment optimization platform. The Service allows you to:

  • Create and run A/B experiments on your websites
  • Use AI-powered optimization to generate and test variations
  • Track visitor behavior and conversion metrics
  • Analyze experiment results

3. Account Registration

To use the Service, you must create an account by providing a valid email address. You are responsible for maintaining the security of your account and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update this information as necessary.

4. Subscription and Payment

The Service offers both free and paid subscription plans. Paid subscriptions are billed monthly in advance. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

No Refunds: All payments are final and non-refundable. You may cancel your subscription at any time, and you will retain access to paid features until the end of your current billing period.

We reserve the right to change our pricing at any time. Price changes will be communicated in advance and will take effect at the start of your next billing cycle.

5. AI-Generated Content

The Service includes AI-powered features that may automatically generate content variations for your experiments. You acknowledge and agree that:

  • AI-generated content is provided "as is" without any warranty of accuracy, appropriateness, or fitness for any particular purpose.
  • You are solely responsible for reviewing and approving any AI-generated content before it is displayed to your users.
  • We are not liable for any damages, losses, or consequences arising from AI-generated content displayed on your website.
  • If your business operates under specific compliance or regulatory requirements, you should use the manual approval mode to review all content before publication.

You retain full responsibility for ensuring that all content displayed through the Service complies with applicable laws, regulations, and industry standards.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Display illegal, harmful, threatening, abusive, or otherwise objectionable content
  • Infringe on the intellectual property rights of others
  • Transmit malware, viruses, or other malicious code
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Resell, redistribute, or sublicense the Service to third parties
  • Use the Service in a way that could damage our reputation or goodwill

We reserve the right to suspend or terminate your account if you violate these terms.

7. Your Data

You retain ownership of all data you provide to the Service, including experiment configurations, goals, and results.

Data Retention: If you cancel your subscription, your account and data will remain accessible. You may continue to log in to view your data or delete it at any time. We will retain your data until you choose to delete it or request account deletion.

We may collect and process visitor data from your websites as necessary to provide the Service. Please refer to our Privacy Policy for details on how we handle data.

8. Intellectual Property

The Service, including its design, features, and functionality, is owned by us and is protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription period.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee any specific results from using the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California, and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any disputes will be resolved on an individual basis and not as part of any class, consolidated, or representative action.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the modified terms.

14. Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We may terminate or suspend your account at any time for violation of these terms or for any other reason at our sole discretion.

Upon termination, your right to use the Service will cease immediately. Sections of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
